Terms of Service
Last updated: 31 October 2026
Tegami is a BentoHub product owned and maintained by The Bailiwick Academy Inc. ("TBA", "we", "us"). These terms are an agreement between TBA and the business or person using Tegami ("you", "the Customer"). By signing in to or using Tegami you agree to them.
1. Who provides Tegami
Tegami is provided by:
The Bailiwick Academy Inc.
One San Miguel Building, San Miguel Avenue corner Shaw Boulevard
Barangay San Antonio, Ortigas Center, Pasig City 1600, Philippines
Service enquiries: hello@tegami.bentohub.co
TBA is also the party you pay. "BentoHub" is the name of TBA's family of software products.
2. The service
Tegami is an email marketing and customer-communication platform. Depending on your plan it includes subscriber lists, segments, broadcasts, automated sequences, forms and surveys, an inbox for replies, booking pages, AI-assisted drafting and analysis, and an API.
We may improve, change or remove features over time. If we remove a feature that is central to a plan you have paid for, we will tell you in advance where we reasonably can.
3. Accounts and workspaces
- Workspaces are set up by TBA. There is no self-serve sign-up.
- Your sign-in is a BentoHub account. The same account may also give access to other BentoHub and TBA services you use.
- You are responsible for the people you invite to your workspace, for what they do there, and for keeping passwords and API keys confidential. Tell us promptly if you believe an account or key has been compromised.
- You must be at least 18 years old and able to enter a binding contract on behalf of the business you represent.
4. Your responsibilities when sending email
Tegami sends mail through sending infrastructure that is shared with other customers, so one customer's poor practice can harm everyone's deliverability. You agree that:
- You will only email people who have given you permission, or with whom you otherwise have a lawful basis to communicate. You will not upload purchased, rented or scraped lists.
- You will comply with the laws that apply to your messages, including the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), the U.S. CAN-SPAM Act, and any anti-spam or privacy law of the countries your recipients live in.
- Every marketing email will identify you, include a working way to unsubscribe, and include your postal address. Tegami adds an unsubscribe mechanism and a postal-address footer to marketing mail, but you remain responsible for the content.
- You will not send content that is unlawful, deceptive, defamatory, harassing, sexually explicit, or that infringes someone else's rights, and you will not send malware or phishing.
- You will not try to get around sending limits, suppression lists or security controls.
To protect the shared infrastructure, Tegami automatically watches bounce and complaint rates. If they pass published thresholds, we may warn you, pause marketing sends, or suspend the workspace. Addresses that hard-bounce or complain are suppressed for every customer.
5. Plans, limits and fees
- Your plan, its price, billing period and limits (such as daily or monthly sends, subscriber count and storage) are those set out in your order, quotation or plan as agreed with TBA.
- Prices are in Philippine pesos unless stated otherwise and are exclusive of applicable taxes, which will be added where required.
- If your plan renews automatically, it renews for the same period at the then-current price until you cancel. We will give you reasonable notice of any price change before it applies to a renewal.
- Usage above an included allowance may be charged as stated in your plan or order.
6. Payment
All payments for Tegami are made to The Bailiwick Academy Inc. and are processed through TBA's payment providers, which currently include Xendit and PayPal. Charges will appear on your statement under The Bailiwick Academy's name. Card and account details are handled by the payment provider. TBA does not store them.
If a payment is not received when due, Tegami may restrict your workspace. Marketing sends stop first while transactional mail keeps working, and the workspace may later be suspended until the balance is settled.
7. Cancellation and refunds
You may cancel at any time by contacting us. Cancellation takes effect at the end of the current paid period, and you keep access until then. Fees already paid are not refundable except where required by law or agreed in writing with TBA.
8. Your data
- You own the data you put into Tegami, including your subscriber lists, content and the replies you receive ("Customer Data").
- For Customer Data, you are the personal information controller and TBA acts as your personal information processor. We process it only to provide Tegami to you, on your instructions and as described in our Privacy Policy.
- You are responsible for having a lawful basis for the personal information you upload, and for honouring your contacts' requests to access, correct or delete it. Tegami gives you the tools to do so.
- When the agreement ends, you may ask us to export your Customer Data within 30 days. After that, we will delete it within a reasonable period, except where the law requires us to keep it.
9. AI features
Some features use AI models to draft content, sort and summarise replies, and analyse call transcripts. AI output can be wrong. You are responsible for reviewing it before you rely on it or send it. The one exception is an auto-reply rule you create and switch on yourself, which sends AI-written replies without review. Our AI provider does not use your content to train its models.
10. Connected services
If you connect a third-party service such as Google, Zoom or an IMAP mailbox, you authorise Tegami to access it as needed for the feature you turned on. Your use of that service is also governed by its own terms. You can disconnect it at any time.
11. Acceptable use of the platform
You will not reverse engineer, resell or overload the service, probe it for vulnerabilities without our written permission, or use it to build a competing product.
12. Suspension and termination
We may suspend or end your access if you materially breach these terms, if your use puts the shared infrastructure or other customers at risk, or if the law requires it. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
13. Intellectual property
TBA owns Tegami, the BentoHub name and marks, and all related software. These terms give you a non-exclusive, non-transferable right to use Tegami during your subscription. They do not transfer any ownership.
14. Warranties and liability
We will provide Tegami with reasonable skill and care. Otherwise, and to the extent the law allows, it is provided "as is", and we do not guarantee that it will be uninterrupted or that every email will be delivered. To the extent the law allows, TBA is not liable for indirect or consequential losses such as lost profits or lost data. TBA's total liability under these terms is limited to the fees you paid in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
15. Changes to these terms
We may update these terms. We will post the new version here with its date and, for material changes, tell you by email or in the app at least 30 days before they take effect. If you keep using Tegami after that, you accept the new terms.
16. Governing law
These terms are governed by the laws of the Republic of the Philippines. Disputes are subject to the exclusive jurisdiction of the courts of Pasig City.
